Welcome to Durvey.org, a service operated by Beleo Labs GmbH ("Durvey.org", "we", "us", or "our"). These Terms of Service ("Terms") govern your use of Durvey.org and related services provided by Beleo Labs GmbH. By accessing or using our services, you agree to comply with these Terms. Please read them carefully.

Our services include various tools that allow you to create, manage, and analyze surveys and panels, encompassing both free and paid features. Use of our platform is also subject to our Privacy Policy, Impressum / Legal Disclosure, and, where applicable, Terms of Participation for survey respondents. Please review these documents carefully before using our services.

2. Scope of Services and User Roles

Durvey.org offers a broad range of services including survey creation, panel management, reporting, data export, and integrations with third-party platforms. Users may have different roles on the platform.

Personal Users register individual accounts for private or personal use, while Corporate Users represent companies or organizations and must designate authorized representatives to manage their accounts. Corporations are responsible for all activities conducted under their corporate accounts. Individuals are responsible for all activities conducted under their personal accounts.

3. Account Registration and Security

To use Durvey.org (operated by Beleo Labs GmbH), you must register for an account with accurate and up-to-date information. You are responsible for keeping your password confidential and for any activities performed under your account.

Sharing your login credentials or allowing others to access your individual account is strictly prohibited. If collaboration is needed, each participant must have their own user account. If you suspect unauthorized access to your account, please notify us immediately at contact@durvey.org.

We also reserve the right to temporarily or permanently suspend user access without prior notice if there is reasonable suspicion of abusive behavior, legal violations, or actions that threaten the integrity, security, or performance of the platform.

4. Availability and Maintenance

While we strive to provide continuous and reliable service, we cannot guarantee uninterrupted access to the platform. Scheduled maintenance and unforeseen technical issues may occasionally cause temporary service outages. We disclaim liability for any downtime or service interruptions.

We provide support on a best-effort basis. There is no guaranteed response time unless explicitly defined in a service-level agreement (SLA).

5. Contract Duration, Termination, and Renewal

Your use of Durvey.org is governed by these Terms for as long as you use our services. Paid subscriptions may be cancelled according to their specific terms. We reserve the right to suspend or terminate accounts that violate these Terms without prior notice.

Durvey.org reserves the right to suspend or terminate user accounts at any time and without prior notice in the event of repeated or serious violations of these Terms, abusive behavior, security threats, misuse of services, or unlawful use of the platform. This includes but is not limited to unauthorized access attempts, content violations, system misuse, or endangerment of other users' rights and data.

Suspension or termination may also occur if you breach applicable laws, misuse the service for prohibited purposes, or fail to comply with required legal documentation responsibilities as outlined in these Terms. We may take temporary or permanent action at our sole discretion and are under no obligation to restore access once an account has been terminated for cause.

6. Payment Terms

Certain features and services on Durvey.org require payment. We accept major payment methods through secure third-party processors. Payment terms, billing cycles, and fees are outlined in your subscription plan. Refunds are only provided under the conditions described in our Refund Policy. See Section 19 for full details.

7. Third-Party Services and Integrations

Durvey.org may offer integrations or connections to third-party tools (e.g., Google Sheets, CRMs, email providers). Use of these services is at the user's own risk. We do not assume liability for failures, data loss, or legal issues resulting from the use of external services. Users are responsible for checking the legal and technical compliance of such third-party connections.

8. Team Functions and User Access

Where the platform supports team collaboration, you may grant access to other users by creating individual accounts for each team member. Every user must register with a unique personal email address. Sharing accounts or passwords is not allowed under any circumstances.

Each team member is responsible for the actions taken under their account, and administrators are accountable for the oversight of all users within their organization.

9. User Responsibilities and Prohibited Conduct

Users agree not to upload, distribute, or create content that is unlawful, offensive, or infringes the rights of others. All survey content, including questions and media, must comply with applicable laws and respect intellectual property rights.

You are responsible for complying with data protection laws, such as the GDPR, particularly regarding the collection and processing of personal data from survey participants. You must provide all necessary legal disclosures to participants as required by law.

All users agree to use Durvey.org in a lawful and respectful manner. The following behaviors are strictly prohibited:

  • Publishing, sending, or uploading harassing, offensive, illegal, or misleading content
  • Violations of third-party rights, including copyright, trademark, or data protection rights
  • Generating fake survey participants or manipulating results in any way
  • Attempting unauthorized access to system areas, accounts, or data of other users

In the event of suspected misuse or legal violations, Durvey.org reserves the right to block accounts immediately and initiate further investigation. This may result in account termination and legal consequences.

Users are solely responsible for all actions carried out via their user account, even if performed by third parties who gained access through negligent handling of credentials. Durvey.org reserves the right to monitor usage patterns and analyze user activity in cases where there is reasonable suspicion of abuse, fraud, or violations of the law. We may take technical and legal action, including data access logs, temporary suspension, or reporting to authorities, where necessary to protect the platform and its users.

Durvey.org is not intended for use in environments where failure of the service could lead to death, injury, or serious harm, such as in medical, emergency, or critical infrastructure contexts. Any use of the service in such high-risk areas is at your own risk.

Users are solely responsible for complying with applicable export control laws and international data transfer requirements when using Durvey.org from outside the EU.

10. Content Responsibility and Legal Requirements

Users are solely responsible for all content they upload, create, or distribute via Durvey.org (operated by Beleo Labs GmbH), including questions, text, images, videos, and other media.

Before using the platform for public distribution or live projects, users must ensure that the following legal documents are fully and visibly provided:

  • A legally compliant Impressum (Legal Disclosure)
  • A valid Privacy Policy/Information applicable to the type of data collected
  • Optional but recommended: Terms of Participation for survey respondents
  • A valid email signature including company information and contact details

Durvey.org does not review or verify the legal sufficiency of user-provided content. Any legal claims arising from the absence, incompleteness, or incorrectness of such content are the responsibility of the user alone.

Durvey.org does not conduct legal or editorial reviews. The platform is no substitute for professional legal consultation. Any use of the platform does not substitute legal consultation or compliance review.

Use of Durvey.org without proper legal texts is strictly prohibited. Use of Durvey.org does not relieve users of their legal obligations under industry-specific regulations (e.g., healthcare, finance, consumer protection). We do not provide legal, compliance, or regulatory advice.

11. Email Sending and Contact Permissions

The sending of survey invitations or marketing communications via Durvey.org must comply with all applicable laws and regulations, including the GDPR, ePrivacy Regulation, and national email marketing laws.

Specifically:

  • Only recipients with valid prior consent may be contacted
  • The content and recipient list must be reviewed by the user prior to sending
  • Proof of consent must be retained and provided upon request
  • Unsolicited bulk emailing, spam, or deceptive messaging is strictly prohibited

Durvey.org acts solely as a technical service provider ("Processor") for email dispatch initiated by users. Users are the sole originators of communication content and are responsible for ensuring that all email recipients have provided valid consent.

Durvey.org does not verify or moderate message content or recipient lists and accepts no liability for legal violations or deliverability issues (e.g., blacklisting, spam classification, bounces). Durvey.org assumes no responsibility for email campaigns initiated by users. Users bear full liability for any legal violations, including potential fines and claims by third parties.

12. Fair Use and Technical Restrictions

Users must not engage in automated or excessive use of the platform that could impair system stability or other users' access. Durvey.org reserves the right to apply rate limits, throttle traffic, or suspend services in the event of excessive system load or abuse.

Scripts, crawlers, or unauthorized API access are prohibited without our prior written consent.

13. Data Protection and Privacy

We process your data and the data of your survey participants only based on your instructions. Please refer to our Privacy Policy for detailed information on how data is handled and stored, as well as your rights.

You are responsible for obtaining all necessary consents for processing personal data under applicable laws. Durvey.org acts as a data processor in accordance with Article 28 GDPR for all personal data collected or processed through surveys.

Users are the data controllers and must ensure that all legal obligations toward data subjects are met, including providing legally valid privacy notices, obtaining consent, and handling data subject requests. We do not assume liability for the lawfulness of the data collection carried out via the platform.

Durvey.org may log user activities and access patterns for security and compliance purposes. In case of a dispute, these logs may serve as evidence.

Durvey.org uses subprocessors (e.g., hosting providers, email delivery services) for platform operations. A list of such subprocessors is available upon request or in our Privacy Policy.

14. Force Majeure Clause

Durvey.org shall not be liable for delays or failure to perform due to causes beyond its reasonable control, including but not limited to natural disasters, government actions, internet outages, or force majeure events.

15. Changes to Terms

Durvey.org may update these Terms from time to time. Changes will be communicated through notifications on the platform or via email. Your continued use of our services after such updates signifies your acceptance of the revised Terms.

16. Liability and Disclaimer

We are liable for damages caused by intentional misconduct or gross negligence. For minor negligence, our liability is limited to damages that are foreseeable and typical for this type of contract.

We disclaim liability for indirect, incidental, or consequential damages as well as for any loss of data caused by user actions, software errors, or external factors. We do not guarantee uninterrupted service and are not responsible for service interruptions due to maintenance or issues with third-party services.

Durvey.org shall not be liable for any legal violations or damages resulting from user-generated content, survey activities, or data processing conducted by users. Users acknowledge that they act independently and bear sole responsibility for their legal compliance.

In particular, Durvey.org shall not be considered a data controller under data protection law for any survey content, processing activities, or participant communication carried out by users via the platform.

We do not guarantee that the use of our platform will lead to any specific outcome, insight, or success in your business or research objectives. The platform is provided "as-is" without any warranty as to fitness for a particular purpose. Durvey.org is not liable for any data losses, errors in analysis, or misinterpretation of results by users or third parties.

17. Notes on Analysis Features, Automated Suggestions, and AI-Generated Content

Durvey.org provides smart features to support you in analyzing surveys, interpreting results, and generating written content. These include automated analyses, linguistic suggestions, statistical evaluations, and AI-generated content ("AI-supported content").

We strive to deliver these features with care, technical accuracy, and high quality. However, due to the inherent limitations of automated systems, calculations, interpretations, or text suggestions may occasionally contain errors, be incomplete, or lead to misunderstandings.

Please note the following:

  • All calculations and analytical results are based on the data and parameters you provide. No full statistical or expert review is automatically performed.
  • Automatically generated texts (e.g., summaries, sample questions, interpretations) are intended as suggestions or guidance only. They do not constitute final, legally binding, or academically verified content.
  • No plagiarism check or verification of originality or copyright compliance is performed.
  • Users are solely responsible for reviewing, verifying, and using any AI-supported content.

We strongly recommend that all generated or suggested content be carefully reviewed before being published or used, especially in academic, legal, or professional contexts.

By using these features, you acknowledge that Durvey.org cannot guarantee the accuracy, legal compliance, or usability of automatically generated content and that responsibility for its use rests entirely with you.

18. Indemnification

You agree to indemnify and hold Durvey.org harmless from any claims, damages, or expenses arising from your use of the platform, including violations of these Terms or infringement of third-party rights.

19. Refund Policy

Refunds are only granted for unused services or subscriptions that have not yet commenced. Fees for services that have already been utilized, such as survey creation, survey edit, sending invitations, exporting data, or accessing analytics, are non-refundable.

20. Dispute Resolution and Governing Law

These Terms are governed by the laws of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

If you have any complaints or disputes, please contact us at contact@durvey.org first. If the issue cannot be resolved, you may seek assistance from consumer protection authorities.

The place of jurisdiction for all disputes arising from or in connection with these Terms shall be Germany. This applies to both national and international users.
